Terms of Service

These Terms of Service ("Terms") govern your access to and use of CamOnsite's mobile applications, web admin dashboard, APIs, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.

If you are using the Services on behalf of a business, you represent that you have authority to bind that business, and "you" refers to that business.

You must provide accurate account information and keep your credentials secure. CamOnsite supports role-based access for business owners, supervisors, office admins, field technicians, and platform administrators. You are responsible for activity under your account and for managing permissions within your organization.

You agree not to:

• Use the Services unlawfully or in violation of applicable regulations
• Upload malicious code or attempt to disrupt or probe the Services
• Access data or accounts without authorization
• Misrepresent your identity, role, or affiliation
• Use AI-generated outputs as a substitute for required professional judgment, safety checks, or regulatory compliance

You retain ownership of content you submit to the Services, including photos, videos, audio, notes, job data, and documents ("Customer Content"). You grant CamOnsite a limited license to host, process, transmit, and display Customer Content solely to provide and improve the Services, including AI-assisted checklist matching, transcription, and report generation.

You are responsible for obtaining any rights, notices, or consents required to collect and upload Customer Content, including from job-site occupants, employees, and third parties.

CamOnsite may use automated systems to analyze media, extract checklist items, transcribe audio, and suggest next steps. AI outputs may be incomplete or inaccurate. You are responsible for reviewing outputs before relying on them for job completion, customer communication, or compliance purposes.

We strive to keep the Services available and reliable, including offline functionality on supported mobile devices. However, the Services are provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features with reasonable notice where practicable.

Each party will use reasonable care to protect confidential information received through the Services. You are responsible for configuring user access appropriately within your organization.

To the fullest extent permitted by law, CamOnsite disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that AI-generated results will be accurate or complete.

To the fullest extent permitted by law, CamOnsite and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising from or related to the Services. Our aggregate liability for claims arising out of or relating to the Services will not exceed the greater of (a) amounts paid by you to CamOnsite in the twelve (12) months before the claim or (b) one hundred U.S. dollars (USD $100).

You will defend and indemnify CamOnsite against claims arising from your Customer Content, your use of the Services, or your violation of these Terms or applicable law.

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms or if required for security or legal reasons. Upon termination, your right to use the Services ends, though provisions that by their nature should survive will remain in effect.

We may update these Terms from time to time. If we make material changes, we will provide notice through the Services or by email. Your continued use after the effective date constitutes acceptance of the updated Terms.
